Under all the circumstances of this trial, I am clearly of opinion that there has been as complete a miscarriage of justice as ever furnished the grounds on which, in a civil action, a new trial has been granted. It is unnecessary to say that no such redress can be had in the present case.
I have the entire conviction that the guilty purpose of the defendant was fully established in proof. His acts were undisputed, and indeed, in the face of his letters, indisputable.
The occasion appeared to call for this Report of my proceedings, which I beg may be considered in conjunction with the Reports previously handed in on this subject.
